Welcome to Makomu. These Terms of Use (the “Terms”) govern your access to and use of the Makomu platform, websites and applications (the “Service”). By creating an account or using the Service, you agree to be bound by these Terms. Please read them carefully.
1. Who we are
Makomu is a platform that lets creators launch a community, publish courses and engage their audience. The Service is operated by Shortia LLC (“Shortia”, “we”, “us” or “our”).
Throughout these Terms, “Makomu” refers to the product, and “Shortia LLC” refers to the company that provides it.
2. Accepting these Terms
By accessing or using the Service, you confirm that you have read, understood and agreed to these Terms, as well as our Community Guidelines and Privacy Policy.
If you do not agree with any part of these Terms, you must not use the Service.
3. Eligibility and your account
You must be at least 16 years old, or the minimum age of digital consent in your country, to use Makomu. By using the Service you represent that you meet this requirement.
You are responsible for keeping your login credentials confidential and for all activity that happens under your account. Notify us immediately of any unauthorized use.
4. Communities and creator content
Makomu lets creators (“Creators”) build communities, publish posts, courses, files and other materials (“Content”). Creators are solely responsible for the Content they publish and for managing their communities.
Shortia LLC does not endorse and is not responsible for Content created by Creators or members. Each community may set its own additional rules, provided they do not conflict with these Terms or our Community Guidelines.
5. Your content and license
You retain ownership of the Content you create. By publishing Content on Makomu, you grant Shortia LLC a worldwide, non-exclusive, royalty-free license to host, store, reproduce and display that Content solely to operate and improve the Service.
You are responsible for ensuring that you have all the rights necessary to publish your Content and that it does not infringe the rights of others.
6. Acceptable use
You agree to use the Service lawfully and in line with our Community Guidelines. You must not misuse the Service, attempt to access it through unauthorized means, disrupt its operation, or use it to harm others.
We may suspend or remove Content and accounts that violate these Terms or applicable law.
7. Payments, subscriptions and refunds
Creators may sell paid memberships or courses. Payments are processed by third-party payment providers, and Creators are responsible for the pricing, delivery and tax treatment of what they sell.
Refunds are handled according to the policy of the relevant Creator and the rules of the payment provider, subject to applicable consumer law.
8. Intellectual property
The Makomu name, logo, software and design are the property of Shortia LLC and are protected by intellectual property laws. You may not copy, modify or distribute them without our prior written consent.
All rights not expressly granted to you under these Terms are reserved by Shortia LLC.
9. Third-party services
The Service may integrate third-party tools (for example payment, email or analytics providers). Your use of those services may be subject to their own terms, and Shortia LLC is not responsible for them.
10. Suspension and termination
You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms, create risk for the Service or other users, or where required by law.
Provisions that by their nature should survive termination (such as intellectual property and liability) will remain in effect.
11. Disclaimers and limitation of liability
The Service is provided “as is” and “as available”. To the maximum extent permitted by law, Shortia LLC disclaims all warranties and is not liable for any indirect, incidental or consequential damages arising from your use of the Service.
Nothing in these Terms limits liability that cannot be excluded under applicable law.
12. Changes to these Terms
We may update these Terms from time to time. When we make material changes, we will notify you through the Service or by other reasonable means. Continued use after changes take effect means you accept the updated Terms.
13. Governing law
These Terms are governed by the laws applicable to Shortia LLC, without regard to conflict-of-law principles. Any dispute will be subject to the competent courts, unless mandatory law provides otherwise.
